TERMS OF SERVICE

1. Agreement to Terms

Welcome to BLIGHT FORCE™. These Terms of Service ("Terms") govern your access to and use of our website, services, territory franchise programs, property reporting tools, and events (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use our Services. We reserve the right to modify these Terms at any time, and your continued use of the Services constitutes acceptance of any changes.

2. Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our Services under applicable law
• Provide accurate and complete information when required
• Comply with all applicable federal, state, and local laws

For franchise and territory applications, additional eligibility criteria apply and are outlined in the franchise disclosure documents provided during the application process.

3. Property Reporting

3.1 Report Submission

When you submit a property report, you agree to:

• Provide accurate and truthful information about the property
• Only report properties you have personally observed or have credible information about
• Not submit false, misleading, or malicious reports
• Acknowledge that reports are reviewed and may be acted upon by territory operators

3.2 Report Confidentiality

Reporter identity is kept confidential and is not shared with property owners, third parties, or the public. Reports are used solely for property assessment and remediation purposes by authorized BLIGHT FORCE™ personnel and territory operators.

3.3 Report Accuracy

BLIGHT FORCE™ reserves the right to verify, reject, or close any report at its discretion. Submission of a report does not guarantee that action will be taken.

4. Franchise and Territory Applications

4.1 Application Process

By submitting a franchise application, you acknowledge that:

• Application submission does not guarantee approval or territory award
• All information provided must be accurate and complete
• BLIGHT FORCE™ may conduct background and financial verification
• Territory availability is subject to change without notice
• Separate franchise agreements govern awarded territories

4.2 Operator Obligations

Approved territory operators are bound by a separate Franchise Agreement and must comply with all BLIGHT FORCE™ standards, training requirements, and operational guidelines.

5. Use of Services

5.1 Permitted Use

You may use our Services for lawful purposes only, including:

• Reporting blighted, vacant, or unsafe properties
• Researching territory franchise opportunities
• Accessing educational content and webinars
• Networking with blight remediation professionals
• Staying informed about blight redevelopment news

5.2 Prohibited Conduct

You agree not to engage in any of the following:

• Submitting false, fraudulent, or malicious property reports
• Impersonating any person, entity, or BLIGHT FORCE™ representative
• Harassing, threatening, or abusing other users or staff
• Uploading viruses, malware, or malicious code
• Attempting unauthorized access to systems or data
• Scraping or harvesting data without permission
• Using automated bots or scripts
• Reverse engineering or decompiling our software
• Selling or commercializing our Services without authorization
• Violating any applicable laws or third-party rights

6. Intellectual Property

6.1 Our Content

All content on our website — including the BLIGHT FORCE™ name, logo, text, graphics, images, videos, and software — is owned by or licensed to us and protected by intellectual property laws. You may not reproduce, distribute, or exploit our content without express written permission.

6.2 User Submissions

When you submit property reports, photos, or other content, you grant BLIGHT FORCE™ a non-exclusive, royalty-free license to use, reproduce, and distribute that content for blight assessment and remediation purposes. You represent that you have the right to submit such content.

7. Events and Webinars

7.1 Registration

When you register for BLIGHT FORCE™ webinars or events, you agree to provide accurate information and acknowledge that events may be recorded. Capacity may be limited and registrations are subject to availability.

7.2 Cancellation and Refunds

• Cancellations 30+ days before event: Full refund
• Cancellations 15–29 days before: 50% refund
• Cancellations less than 14 days before: No refund
• BLIGHT FORCE™-initiated cancellations: Full refund

7.3 Event Changes

We reserve the right to modify event schedules, speakers, format, or location. We will make reasonable efforts to notify registered participants of significant changes.

8. Disclaimers and Limitations of Liability

8.1 "AS IS" Basis

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ACCURACY OF CONTENT.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLIGHT FORCE™ SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless BLIGHT FORCE™, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Submission of false or misleading property reports
• Your violation of any third-party rights

10. Dispute Resolution

10.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@blightforce.com to attempt informal resolution within 60 days.

10.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association in the United States.

10.3 Class Action Waiver

You agree that disputes must be brought on an individual basis only, and not as a class action or representative proceeding.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any legal action shall be brought in the appropriate federal or state courts of the United States.

12. Changes to These Terms

We may modify these Terms at any time by posting the updated version on our website. Material changes will be notified via email or prominent notice. Your continued use of our Services after changes constitutes acceptance.

13. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full effect. Our failure to enforce any right or provision shall not constitute a waiver of such right.
